“Nebraska Talks” Official Rules

ELIGIBILITY:
This contest is open only to individuals who are Nebraska residents and 19 years of age and older as of September 14, 2015. Additionally, individuals must have a valid Twitter account to enter the contest.

The Sponsor of this contest is the University of Nebraska, located at 3835 Holdrege Street, Lincoln, Nebraska 68583.  Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six months, performed services for either the Sponsor or any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the contest or supplying the prize, and/or their respective parent, subsidiary, affiliated and successor companies, and immediate family and household members of such individuals, are not eligible to enter the contest. “Immediate family members” shall mean parents, stepparents, children, stepchildren, siblings, stepsiblings, or any of their spouses. “Household members” shall mean people who share the same residence at least three months in one calendar year.

HOW TO ENTER:
Individuals may enter the contest by posting questions and comments about or related to the University of Nebraska or higher education in Nebraska (the “Topic”) on Twitter between 12:00 a.m. (all times Central Standard Time) on September 14, 2015 and 11:59 p.m. on September 30, 2015 (the “Contest Period”) to @HankBounds, tagged with #PrezUnplugged. Any posts received after 11:59 p.m. on September 30, 2015 will not be considered for prizes, regardless of whether the late receipt resulted from human, computer or transmission error or other cause. No purchase is necessary to enter or win.

An entry consists of all posts made by an individual using a specific Twitter account during the Contest Period. An individual may only enter the contest once during the Contest Period. Any individual found using multiple Twitter accounts will be disqualified.

All entries must be original content of the entrant. No entry may contain any elements that violate a third party’s intellectual property rights or any applicable laws. All entries must comply with Twitter’s terms of use.

PRIZE:
Two (2) individuals will be selected as winners from all qualified entries on or about October 7, 2015. Winners will be selected based on the criteria set forth in these Official Rules.

Each winner will receive two (2) Skybox Tickets for the Saturday, October 24, 2015 UNL Home Football Game against Northwestern University to be used by the winner and one (1) guest of the winner. The winner’s guest must be 19 years of age and older as of September 14, 2015, or the winner’s guest may be under 19 years of age if the winner is the parent/stepparent, grandparent or legal guardian of his or her guest. Parents or legal guardians of guests under 19 years of age as of September 14, 2015 must consent in writing to such minor being a guest and to these Official Rules, to the extent applicable, in order for a minor to be a guest. The Sponsor may require parents or legal guardians to sign additional consents as determined by the Sponsor in order for a minor to be a guest. The Sponsor reserves the right to disqualify any potential guest in its sole discretion. The Sponsor is not responsible if the October 24, 2015 UNL Home Football Game against Northwestern University is cancelled, postponed or delayed for any reason whatsoever, and the Sponsor will not be obligated to award a replacement prize.

The ARV of each prize (which consists of two (2) Skybox Tickets) is $220. All federal, state and local taxes associated with the receipt or use of any prize are the sole responsibility of the winner. Food will be served in the Skybox during the game and such food is included in the prize; however, all other incidental expenses, including but not limited to transportation, lodging and meals, and all other costs and expenses which are not specifically listed as part of a prize in these Official Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the prize are solely the responsibility of the winner.  A winner may choose to decline the prize, and in such event the Sponsor will award the prize to the next qualified entry based on the selection criteria.

SELECTION CRITERIA:
There will be three rounds of judging to select the winners. In the first round, all entries will be evaluated by the University of Nebraska communications team (the “Communications Team”) based on the depth of the conversation with respect to the Topic and will be awarded up to 10 points. Those entries with the highest scores in the first round will advance to the second round.  The specific number of entries that will advance will depend on the total number of entries received, with the specific number determined by the Communications Team. In the second round, the remaining entries will be evaluated by the Communications Team and President Hank Bounds based on three criteria: (1) creativity (up to 4 points); (2) thoughtfulness (up to 6 points); and (3) relevance to the Topic (up to 10 points). The specific number of entries that will advance to the third round will depend on the total number of entries received, with the specific number determined by the Communications Team.  In the third round, President Hank Bounds will select the two (2) winners from those entries that advance from the second round based on which entries represent the opportunity for further meaningful discussion on the Topic.

Each winner will be notified by a message from the Sponsor on Twitter on or about October 7, 2015. Such notification will include instructions on how to claim the prize. To claim the prize, a winner must follow the instructions in the notification. Prizes must be claimed within forty-eight (48) hours of the notification. If the individual does not claim the prize within this time period, then the Sponsor will award the prize to the next qualified entry based on the selection criteria.

All prizes are non-transferable. No cash or other substitutions are allowed. Decisions of the judges and the Sponsor are final. Each individual’s odds of winning are dependent on the overall number and quality of entries submitted during the Contest Period.

In the event a winner does not meet these Official Rules or eligibility requirements as determined by the Sponsor, he or she forfeits the prize. In such event, the Sponsor will award the prize to the next qualified entry based on the selection criteria. This process will continue until the prize is awarded.

SAFETY, SECURITY AND UNIVERSITY POLICIES:
By entering this contest and/or accepting the use of the prize, each winner and his or her guest agree that the Sponsor may, at its option, conduct a background check on each such person. If the Sponsor chooses to conduct a background check, a separate authorization may be required from each winner and his or her guest as determined by the Sponsor in its sole and absolute discretion. Each winner and his or her guest agree to complete any such additional authorization or otherwise forfeit the prize. The Sponsor reserves the right to disqualify any potential winner and/or his or her guest from receiving any prize based on such background check if Sponsor determines, in its sole discretion, that awarding any prize to such potential winner and/or guest could result in a safety or security risk to any person or persons or could result in the disruption of any event associated with the contest. In the event a winner is disqualified, the Sponsor will award the prize to the next qualified entry based on the selection criteria.

By entering this contest and/or accepting the use of the prize, each winner and their guests agree to all policies, rules and regulations of the Sponsor and its affiliates related to the use of the Prize.

MISCELLANEOUS:
By submitting an entry for this contest, entrants agree to abide by these Official Rules and any decision Sponsor makes regarding this contest and, if selected as a winner, to cause their guests to abide by these Official Rules, to the extent applicable. In case of a dispute over the identity of an entrant, the account holder of the Twitter account used to enter will be deemed to be the entrant. “Account holder” is defined as the person who is assigned to a Twitter account according to Twitter’s records. Each potential winner may be required to provide the Sponsor with proof that a potential winner is the account holder of the Twitter account associated with the winning entry.

Each entrant and any guest of a winner releases the Sponsor and its subsidiaries, and affiliates, and each of their directors, officers, employees and agents from any and all liability for any injuries, losses or damages of any kind directly or indirectly arising from or relating to this contest, any prize, any acceptance, possession or use of any prize, or presence on, near or within the University of Nebraska – Lincoln, or the field, or participation in any activity therein, and waives any and all causes of action, related to any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the content or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.

This promotion and the rights and obligations of the Sponsor, entrants, winner and guests of winners will be governed and controlled by the laws of the State of Nebraska, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings and litigation relating hereto must be instituted and prosecuted solely within the State of Nebraska, Lancaster County. The Sponsor, entrants, winner and guests of winners consent to the exclusive jurisdiction of the state courts of Nebraska and federal courts located within the state and county listed above with respect to any action, dispute or other matter directly or indirectly pertaining to or arising out of this promotion, any prize, any acceptance, possession or use of any prize, presence on, near or within the University of Nebraska – Lincoln, or participation in any activity therein. Entrants, winners and guests of winners in this contest hereby waive any right to jury trial relating to this contest against the Sponsor. With respect to any claim against the Sponsor relating to this contest or any prize, any acceptance, possession or use of any prize, valid service of process and proper filing of any claim in a court of competent jurisdiction must occur within three (3) months of the date such claim accrued, or such claim shall be forever waived, barred and discharged.

By entering this contest and/or accepting the use of the prize, each entrant and any guest of a winner agree to permit (except where prohibited by law) the Sponsor to use his or her photo, video, audio, image, likeness, name, current city, hometown and prize information, without limitation and in any format, for purposes of advertising, promotion and publicity for the Sponsor without compensation or further permission. By entering this contest, each entrant agrees to hold harmless Sponsor and its subsidiaries, and affiliates, and each of their directors, officers, employees and agents from any claims or expenses arising as a result of any allegation that the entrant did not own or was not authorized to allow publication and reproduction of the content included in a post. By entering this contest and/or accepting the use of the prize, each entrant and any guest of a winner agree to hold harmless Sponsor and its subsidiaries, and affiliates, and each of their directors, officers, employees and agents from any claims or expenses arising as a result of any negligence or willful misconduct of such entrant or guest of a winner.

To the extent allowed by applicable law, and subject to the terms of use of Twitter, all entries submitted as part of the contest are the property of the Sponsor. Each entrant agrees that the Sponsor shall be the exclusive owner of all right, title and interest in and to such entries and may use such entries for any purpose without compensation.

The Sponsor reserves the right to modify or change the contest rules, or cancel, suspend or reschedule the contest, at any time in its sole discretion. If for any reason the contest is not capable of being conducted as planned due to any cause beyond the control of the Sponsor, including but not limited to any event or cause which corrupts or affects the administration, security, fairness, integrity or proper conduct of the contest, the Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the contest and disqualify any individual who may have caused any such problem. The Sponsor assumes no responsibility for any theft or destruction, unauthorized access to or alteration of entries. The Sponsor is not responsible for misdirected, lost, late or damaged entries, busy phone signals, unreturned voicemail messages, unreturned email messages, email notifications caught in SPAM filters or other forms of computer protection software or incomplete entries. The Sponsor is not responsible for any problem or technical malfunctions of any telephone network or lines, computer online systems, servers, computer equipment, software, failure of any entry to be received by the Sponsor on account of technical problems or delays, including any injury or damage to an entrant’s or any other person’s computer or mobile device related to or resulting from participation or downloading any materials in this contest.

The Sponsor reserves the right to disqualify from the contest, and to prosecute, and seek damages from, to the fullest extent permitted by law, any entrant or winner who, in the Sponsor’s reasonable suspicion, tampers with the entry process, attempts to deliberately damage any application or web site or undermine the legitimate operation of this contest, violates these Official Rules or acts in an unsportsmanlike or disruptive manner.

By entering this contest, each entrant agrees that (i) any and all disputes, claims, and causes of action arising out of or in connection with this contest or the prize awarded, shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs, directly or indirectly associated with entering this contest, but in no event will attorneys’ fees be awarded or recoverable; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby knowingly and expressly waives all rights to, any damages other than actual out-of-pocket expenses.

Each entrant and any guest of a winner shall execute and deliver such additional documents, instruments, conveyances and assurances and take such further actions as may be required to carry out the provisions of these Official Rules.

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. IN NO EVENT SHALL THE SPONSOR BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, INCIDENTAL OR PUNITIVE DAMAGES, EVEN IF THE SPONSOR HAS BEEN ADVISED OF THE POSSIBILITY OF THE DAMAGES. IN ANY EVENT THE MAXIMUM AGGREGATE LIABILITY OF THE SPONSOR TO ANY PERSON DIRECTLY OR INDIRECTLY RELATING TO THIS CONTEST OR THE AWARD, USE OR ENJOYMENT OF ANY PRIZE SHALL NOT EXCEED THE SUM OF $50.00.
